That doesn't mean he's guilty, but there's no alibi. This example shows your main MISTAKE. We do not have a crime yet. We are not trying to pinpoint who done it, but try to establish if there was a crime in the first place. To pick up on your legal parallels: If somebody accuses you of fraud, should the case be taken to trial based just on that accusation ? Shouldn't the accuser present some evidence to support his accusation ? You reverse the general accepted principle of "innocent until proven guilty". According to your logic anybody can accuse somebody and the accused has to prove his innocense. Most modern LAW-Systems have done away with that kind of thinking decades if not centuries ago. - Rob -
