I think restraint of trade was a good beginning. There was
a great deal of evidence in discovery which pointed to
Fidelity making behind the scene deals to make sure that the
U.S. Federation would get the Excellence and we would not.

Their deal was made LONG before we even considered running
an ad about the product. It happened to be a brilliant plot.
Sid knew that we were not going to easily get the Excellence,
but when he saw the opportunity to sue us, he knew that he
could use that as an excuse not to sell to us at all!
