The rule should be modified by the following: The author have to give the prog three months before to Kramnik. But he can modify the program (and the opening book) until the match. It's clear that it would be unfair for Kramnik, not to have any idea about the opponent, but now it's unfair for the programmer, because Kramnik can study the opening book and the weaknesses of the programs, especially in the endgame.
