Ok - I see where your question is coming from. The game in question has a patent and the owner of the game/patent has expressed a desire to make his commercial and also to protect his patent (which is his right). I have no desire to rehash the sequence of events again except to say I wish the owner of the patent all the best in his endeavor. If you follow the charter, you should be fine.
