If the company couldn't verify that Gandalf 5.1 was "clearly stronger" than
4.32h, then they had no business marketing it as such. "Clearly stronger"
indicates that testing has been done, with definitive results. If they chose to
market the program without such testing, then this is clearly a scam, because
the company does so with the knowledge that consumers will buy a new version
based on expectations of increased strength.

Knowing that some users purchased the product based on misinformation, the
company should offer a free upgrade.
