The problem is that you have not proved that this difference is THAT difference. How you can know that the authors os Bionic just copyed all? Did you examine the source code? What you mean with making "only" modifications? What do you know about the reach of that "only" modifications? IF that is the case, if it is just a cosmetic refurbishing, I am with you.
