The difference is that Fruit was released under the GPL which explicitly allows
derived work. So the real issue is "only" the moral question whether the name
change was a sensible thing to do, not the fact that Toga is derived work.
I do not see any reason why these changes could not be folded back into original
Fruit sources if Fabien wants that.
