You conveniently forget to mention the context in which the word "sucks" was used. For example, if i said: "My chess playing skills sucks today", nobody would have any problems with that, but when you say "Hiarcs sucks" without any intellectual attempt to explain why you made a statement like that (and still haven't mind you) it is considered, whether you like it or not, by the community to be an attack on the programmer of Hiarcs, by the same standards of moderation your rights are protected by the same rules. In other words, the moderation had nothing to do with the word "sucks" but the context it was said in.
