That's the down-side of public domain. I don't recall him having released it to public domain, on earlier versions there was really no documentation that I remember, but I don't think that releases it to public domain. More recent versions, there are some terms, and I don't remember them as releasing TSCP to public domain, I think they have a tighter grip on things. I don't think that the person trying to sell it to the airlines being from Canada means that he can have a free-for-all. Allot of guessing on my part. I think that airlines might find that Chess programs on board would tend to generate some very upset and angry passengers when they've had a few drinks to help them fly, and gotten their butts kicked by Tom's Simple Chess Program, so I'd love to see the aftermath of that showing up on the 10 o'clock news.
