There can be no question that a player can offer his opponent a draw at anytime during the course of a game. Provided a player offers a draw to his opponent in accordance with FIDE article 9.1 which is after he has moved but before he starts his opponents clock then the draw offer is valid. In fact even if he doesnt do it in exactly this manner article 9.1 still says the draw offer is valid however then article 12.5 should be considered. A single draw offer should not be disallowed by an arbiter under artcile 12.5 especially if made in the correct manner. Therefore the operator of Fritz was entirely allowed under FIDE article 9.1 to offer a draw. Some may say it was unsporting others not but it was entirely legal according to the rules. This said would Tiviakov if situation had been reversed and he had the white position been so good as to resign or would he just have waited for his opponent to lose on time and would his actions be different based on whether his opponent was rated 2200, 2500 or 2800.
