These two positions are not the same:

1) In the first case, the last move made was a pawn move, which reset the
50-move counter, leading to a game that is potentially one move longer than in
the second case.

2) The position after 1. d4 Nf6 has occurred in the second game but not in the
first game, so if this position is repeated twice more, the game can be declared
drawn in the second case but not the first case.

These are trivial objections, but depending upon what someone does with the
unique position count data, they may be important.
