If it was logical to capture by the en passant rule in the first case then the line is illogical and I expect the search to find that a capture by the en passant rule is better than repetition except one case when the repetition is of previous position in the game and not in the search. If the no capture by the en passant move is previous move of the opponent in the game and not in the search and the opponent did a mistake by not capturing by the en passant rule there may be a mistake but the same mistake is typical to programs and can be also in other cases when the computer will be happy to repeat a bad position in the game.
