Yes, this is really a dead draw.  White could have played 37.c6 Bxc6 38.d7 Bxd7
39.Bc7.  Then move the bishop to any safe square on b8, c7, d6, or e5.  There
will always be enough safe squares for the bishop and therefore no zugzwang.  If
the black king attacks b2, simply go Be5 and then back and forth between e5 and
f6 if he continues to attack it, and go back to b8/c7/d6/e5 if he steps away
from the b-pawn.
