NO!
If you allow this, then you might as well not do checks in the q search at all.
What is the point of giving check if your opponent is allowed to ignore it?

If you do check in the q search, the side in check must then do a 1 ply search
of all legal moves, to discover if it is checkmate, or if the only legal moves
result in losing lots of material.
