First thing required is to have working code to patent. An "idea" won't cut it. The patent laws are very tightly constrained to make it nearly impossible to patent software of any form. We have an annual patent discussion here with the UAB patent attorneys coming to give an overview of what has changed. It's much easier to patent a device, or a drug, rather than a piece of software.. We don't even try...
