It is his right not to resign.

If you lose on time it is your problem.
You should simply avoid games with no increasment if you want to avoid losing on
time.

In a tournament you can stop the clocks and ask for a draw before you play the
repetition move and only write the repetition move but the rules of ICC may be
different.

I do not know the rules of ICC but I think that it is a good idea to let players
to stop the clocks and ask for a draw without playing a move when they have some
seconds to give the reason for it by playing a move(If the reason is not correct
they will lose 5 minutes on their clock and if the reason is corect the game can
be decided as a draw.
