It is up to the person that makes the move that leads to the three-fold repetition to make the claim to the TD. As I understand the rule, if the opponent moves and breaks the repetition sequence, it's then too late to call this... Same problem happens with the 50 move rule. It doesn't end the game unless you want it to end the game and you play the 50th move for your side and the 50-th move for the opponent's side has already been played. You can claim it if you want.
