I think that exactly for this reason there should be a tournament to decide
about the program to play against Kramnik.

It was not known before WCCC that this tournament is for the right to play
against kramnik.

If it is agreed before the tournament that winning WCCC gives the program the
right to play a match against kramnik in 2001 then I have no problem with it but
thinks like this should be agreed before the tournament so everyone knows before
it what the results of the tournament mean.
