Giving public games of the opponent is enough so I think that kramnik should not get a copy of the program before the match and only get the games of Enrique's tournament. Even if the programmer change the program after Enrique's tournament the changes are probably not big changes like in the case of Deeper blue-kasparov. The main problem with kasparov-Deeper blue games is the fact that kasparov had no public games of something similiar to the program that may be 50 elo weaker but not more than it when Deeper blue had a lot of public games of kasparov.
