Yes, it can be claimed draw because the 3 positions are identical. In neither of
those dxe3 is possible. I do not remember the exact wording but the spirit of
the rules were that the 3 positions should be "photographically" and
"dynamically" identical.

I am not handling this in my engine correctly. Even worse, I follow the silly
FEN convention about the ep squares so it will think that a draw cannot be claim
even if the the black king and black pawn are moved to the left one column. I
think I will drop that convention because it is silly and has no advantage.

Maybe it is not very expensive to put the correct hash signature after you
"play" the move and write it down on the score sheet (you know what I mean, I do
not know what kind of structures you use and how you call it).
At least it will solve the problems when the first position has been played
already and it is not in the tree search.
