They did clone.

What was missing in the "discussions" about them was that they thought so
themselves as well and never tried to hide it. They asked the TD "We used Crafty
and added this and this. Is it different enough or still a clone ?".
The TD had a different opinion than most programmers, and allowed them to play.

They put on their webside what they did; Took Crafty and added an extensive
prescan to it, making it score much better against the old Crafty.

So, guilty for cloning, but the whole story makes them a lot less evil.
