Technically the courts may not agree with you here, but I'm not sure someone
would be prosecuted for giving a game to a friend.  I seem to remember reading
about a ruling to this effect, I'll see if I can find it.

In any case, fair use _is_ a legal concept, as is the concept of "first sale",
the idea that the publisher can only claim royalties on or otherwise restrict
only the first sale of a work.
