At least in Norway, and most likely EU too, a database is in the copyright law just like data programs, even with it's own paragraph. You have to do something for it to not be copyrighted. I would expect an opening book would be counted as an database. But this don't stop an legaly buyer from using it, only for distribute it in any form. I think chessmoves played in a game comes under another term., 'news', that is allowed to distribute. The eco is also copyrighted so a hand made book could not start with moves from this. I did check in the ECO and their opening code system is also copyrighted and could not be used in other publications without their permission. What is allowed in a tournament is another thing, the tournament organizer could put whatever he want in his rules and the participants have to follow that. This gave me some bother before the CCT4, I asked here about the eco issue but didn't get any answer so I had to build a big gm-book with a hand tuned book build up on my own reportoare on top.
