I don't think there's any "spyware" that comes with any version of Windows.
There are a few things that try to send information to Microsoft in case of an
error (so they can hopefully fix it if it's a common thing) or update your
computer automatically with critical security updates and such (which is also
generally a good thing).  However, there is a lot of junk that comes installed
with all versions of Windows, and removing some of the fluff can improve
performance a bit.

Installing _any_ operating system on a laptop can be a nightmare.  Unless you're
completely sure what you're doing, I wouldn't even try it.
