I think it could be programmed like you describe, including the exceptions.

Some programs have similar functions which call for the "next best" move after
the move has been played (this is an old function used before multi-pv mode
became more common).

But such a N-next best handicap level is a very good idea IMO.

If I could beat the 2nd best moves level, I could claim having beaten a computer
opponent "next best to Fritz..." :o))
