In Germany, several courts have argued the question, "to what extent unsolicited advertisement is permitted by E-Mail/". The first decision fell at the regional court trusting stone on 14 October 1997. The court forbade to send it to a company by provisional order "advertisement to private individuals over E-Mail without previous agreement of the person concerned". The high court rule that direct marketing via telephone is only permitted with a previous agreement an existing business relationship. These principle were transferred to direct marketing via fax as well in October 1995. It is assumed that this principle could be applied also to the unsolicted e-mail direct marketing. The court rules that unsolicted email is not permitted. Unsolicted e-mails from a foreign country often has a reference that that the receiver can delete his name from the email list. However, the exact opposite happens - a response confirms that the email address is valid and a response generates many more unsolicted emails. (translator's comment: MSN actually advise their email users not to respond to unsolicted email that gives the receiver the option to be removed form the email list - since what Frank say here is very true.)
