I think that there is agreement that this case is also includes in clones.

I remmeber cases when it was claimed that programs are crafty clone inspite of
not having the same evaluation function.

Not always.

I know at least about one program that is identical to pepito in the search
rules(siboney) and one tscp clone and there are more examples when the only
thing that was changed is the evaluation and not from crafty(see Horizon).
