I suggest you check out
http://www.google.com/search?q=chess+fide+rules+draw+claim
before making any claim like that.

Correct.

P.S. when they continued playing after the draw was declared, Djenghis dropped
it's queen with: 36.Ke5, Nd7+ 37.Ke4, f5+ 38.Qxf5, gxf5. As you can see Shark
avoided the 3rep.
