Wrong answer here.

First, the guy is selling _10_ copies of the files.  Eugene doesn't sell any
so he is making the copies to sell.

Second, Eugene holds the legal copyright on the files, even though he
distributes them freely.  But his copyright makes it illegal for anyone to
sell copies without his express consent.
