Rh7 when I am thinking about that game and playing on a board, I think it should be already claimed as a draw after 5. ... Rh8 ! Because it is the same position then after 1. ... h7 and 3. ... Rh8... I think that the castle rights do not play any role here, because afaik the rule goes a bit like this: Three fold repetition can be declared when a position occurs the third time with the same side to move and the same possible move - because after 1. ... h7 there is no draw possible, the possition after 5. ...
