The clearest evidence is the information on the cover of the product, which would mislead a buyer who picked it up off the shelf. This evidence may or may not be sufficient to stand up in a court of law... don't ask me for my opinion, I'm not a lawyer. On the other hand, it's obvious to anyone who knows the subject matter that Chessbase blundered. Junior 8 is a single processor program, but "the original engine that played in the Kasparov match" is a multi-processor engine. This wasn't deliberate deception by Chessbase, they slipped up. So what are you going to do? Sue them? Think of the possible outcomes: 1. You lose the case: you'll be severely out of pocket because of the legal fees. 2. You win the case: you may still be out of pocket because of the legal fees, but: 2a. You might be allowed to return the program and get your money back. 2b. Chessbase might be forced to give you a free copy of the Deep Junior engine that played against Kasparov. So, what's the point? Isn't it better to talk reasonably to Chessbase and make some sort of a "gentleman's agreement"? I bought Junior 8, I emailed Chessbase to ask why there was only one engine, and I got a reply admitting the mistake and saying "We'll have to do something about it, but we haven't worked out what to do yet". If you send a friendly email to Chessbase you'll get a friendly response. You say that Chessbase told you there was "no evidence that they sold Junior 8 with the extra Junior engines". I don't know what you wrote to Chessbase, Terry, but this sounds like a defensive reply to an unfriendly or demanding email. Let's give Chessbase some time... let's not put them under pressure. Let's see what they come up with.
