It does not matter eventually if they are right or wrong.

If there is really code from Unix in Linux (and actually it is probably the
other way around - that is going to be extremely funny), it will be removed and
replaced by new patent-free code.

So anyway the issue will be cleared and Linux will move forward.

It is much better if those claims happen now than in 5 years.

Really, I cannot see what could stop Linux.
