Point 5 is that the message itself (see the first three lines, before the list!) must not be of questionable legal status. While the legality of the creation or use of the program might be questionable, discussion of whether that program is legal or not is clearly legal. Dave P.S. I'm not trying to give you a hard time. I was a moderator here in the past, it's a pain sometimes. :-)
