I wouldn't keep playing up this 'circumstancial evidence' phrase. It is sounding over-ripe. What kinds of evidence might you expect to be actionable? A confession--not available. A thorough examination of source code-- not available. If you have some other form of evidence-- since ICGA is supplying the equipment--possibly a heap dump (could be the reason to allow LIST to play an extra round) i do not know what might be not refered to as circumstancial as all ideas are inferred from circumstances at the event.
