The only way it could be proven is by some automated code checker. Surprisingly, plagiarism checking is quite a well-developed field and there are some good papers here: http://ir.shef.ac.uk/cloughie/ The rule is where "fair use" stops and "plagiarism" starts. Courts of law in various countries have been considering that issue for over 100 years and have never answered it definitively; the balance between the two has shifted back and forth many times.
