I do not know the facts but if the case is like you describe it should be a draw
because programs should not be punished for operator errors.

I remember that Diep took back moves in the game against quark when Vincent put
the position wrong after Diep crashed and I understood based on watching ICC
that the moves that were based on the wrong position were already done on the
board and quark replied to them(at least the board on ICC was updated to the
wrong position and Vincent posted analysis based on the wrong position).
