What do you mean? By what standard should List's guilt or innocence be
determined by:

(1) List is guilty until proven innocent?
(2) List is innocent until proven guilty?
(3) Guilt or innocence is determined by the preponderance of the evidence?

As far as I see it, by the standards of (2) or (3), List is innocent. Are you
really advocating (1)?
