But the human would have to make a move with the touched piece, if there is a
legal move available. I doubt that's the same in computer chess.

It would be a good thing to have precise rules for computer chess. (which of
course should be as close to the rules for humans as possible) Just taking the
human rules and interpret them for computers will always open holes for "funny"
incidents in the future. (just wait until someone in a CC claims that the
computer has to make a move with the piece, with which it did the illegal move
before)
