But the ICGA has also backed down on that issue as well, leaving it open. If two commercial programs can use the same book, they would find it very difficult to prevent me from using that same book should I be able to gain access to it somehow. Otherwise it is known as "selective enforcement" and it is totally unacceptable anywhere.
