I'm not sure I buy into this argument. You can get the various commercial chess engines via many different avenues. I can buy from Chessbase, from Amazon, from ICD, from my local computer stores, and probably many other places. If I buy all of my chess software from ICD, how is Chessbase or whoever going to know if I bought their software or not? If a friend of mine buys me a chess program for Christmas (which happened this year) no one is going to have any record of my name. If I walk into a computer store and buy a chess program with cash, there is no record anywhere of me owning that program.
