The U.S. Patent Office gives the following definition of what a patent will do
for the person who owns it:

"...exclude others from making, using, offering for sale, or selling
the invention throughout the United States or importing the invention into the
United States..."

I guess it depends how loosely you want to interpret that definition. To me it
says you can't make a program to play gothic chess without a license, regardless
of whether you sell or distribute it.

If you "play" a game, is that the same as "making" a game? Who knows. I'm sure
some lawyer could make it seem equivalent. It is probably best to just avoid the
whole situation, IMO.
