You offer money to lawyers, and then ask them about your patent, I wonder if any lawyer would ever say anything other " we'll help you on that impressive looking idea, it is surely unique". You can't use anything said by a paid retainer in a properly constructed argument, it doesnt make sense. I bet the fact that the lawyers think it a good idea cant be entered as evidence just the same.
