Subject: Need ruling on 3 fold rep pos

   Say you have a position and black moves creating an en-passant opportunity
   for white. (call this position p1 (with white to move)).

       Now white moves a rook
           black moves the king
           white moves rook back to previous position
           black moves king back to previous position
           (call this position p2 (with white to move)).

    does p2 count as another occurance of position p1 eventhough p2 has no
   en-passant opportunities???
