Perhaps I'm missing something but I don't see how the generation of illegal
moves changes this. You still count the number of moves you could actually make
as you are making them and if that's zero you then check whether it's mate or
stalemate at the end.

I guess that if you didn't verify that a move had succeeded before checking the
fifty move counter you could get it wrong.
