They are free to say whatever they like, within reason, just like the rest of us
here, can can only say and do what we are limited to say and do.

Yes he can say that he suspect one person is cheating, but you do not have the
right to name who you suspect is cheating. How would you like it if I posted a
post that said  "Dann Corbit Cheats in ICC" and within the post I wrote that
looking at your games I suspected you of cheating, You would not like that would
you.

And since the moderators say nothing wrong with him naming that name on ICC, I
can only assume that if I did nothing would happen because to them it is not a
big deal. But I would not do that, because at least I know it is wrong.
