There it's no reason to fix it, it seems you have a missundersanding on chess rules. I suggest you to take a look on fide rules and find out how a chess game begins. Then a further read on move rules will teach you that your positions are imposible based on that chess rules... As other authors said, "it's not dificult to fix it". But there it's no real reason to do it besides your "tests". Maybe i will release an "illegal tests" compliant version some day...
