Sale is specifically prohibited in the wording of the copyright notice. I think any public performance would qualify as well. If I run Crafty verses Crafty on my machines, I don't think it matters (though I am not a lawyer). OTOH, if you enter a contest or even play on FICS or ICC, then I think you should disclose your modifications. The copyright notice is even more refined. It simply says that "any" changes must be disclosed. So maybe even my example of my own machines does not qualify.
