Something might not be clear. I think if your points are OK ...

- it is legal for the tester to keep the test version private.

- neither Fabien nor Thomas have control over what the tester does with the
program.

- The tester is allowed to give copies to anyone he wants (but always including
source code if he does so). There is no need for him to make it available to the
whole world.

Am I right?
