Subject: Legal questions about GNU GPL

I do not understand much of the legalities of open source code under the GNU GPL
licensing.

Fruit 2.1 had open source code. Now most of that code is going to be used
commercially with closed code. How is that legally possible?

Toga II used a lot of Fruit 2.1 open source code and it itself is open source
code. Can the author of Toga II use parts of this code to make his own closed
code commercial program?
