There is NO guarantee that you will get such a position with a correct flag, because you are able to create such a position within a traditional chess GUI. Thus it will be no solution to provide any extra flag. ONLY THE POSITION ITSELF could be used as a source to make such a decision, for what ever it should be used (I do overmore not see such a need, because a serious evaluation routine simply depends on the placements of all pieces and the moves being possible from then on).
